Where's the PA guys?
« on: July 08, 2018, 02:07:56 PM »
While cutting some trees down for a person I screwed up and cut down two of the neighbors. I hadn't moved the second tree yet so I left it lay until the owner could get a forester to look at it. The first tree I cut was dead and mostly punky so I showed it to the owner but he said he doesn't care that it was mostly bad, he wants paid from the stump. He told me that was my problem that it's not worth much.

So I'm wondering how all of this works in PA? I offered to sell them and give him the money plus a 100 for me screwing it up but he says no. His forester friend said the two trees are worth 650 and that's what he wants. One was dead and the other has metal in it! I'm going to sell them tomorrow but I'm seriously doubtful I'll get half of what he's asking for. Both trees are in the "woods", neither one was anywhere it could be considered ornamental.

Thanks for your input.

Pay the 650 and put it behind you ! Sound's like you tried to work something out with the owner , he's not buying in so pay the money and be more careful down the road

Tell them youll pay the $650 in exchange for a signed and notarized settlement letter releasing you from all further claims, and non-disclosure agreement about the incident.  Pay with a certified bank check, not cash. Keep it all together in your filing cabinet.

They sound like unreasonable people and might be the type to run around badmouthing you.  Atleast this way you have the piece of mind that you didnt just lose $650.. You got some value for it in the rights to sue the people if they try to ruin your reputation.. which is probably enough to prevent them from blabbing anyhow.
